  1. The proposed development would provide substandard living accommodation for future occupiers of the self-contained accommodation and would fail to ensure safe and healthy living conditions contrary to the requirements of the NPPF, Policy DLP8, DLP14 & DLP39 of the Dudley Local Plan and the Council’s Residential Design SPD & Technical Housing Standards (DCLG 2015).
  2. The proposal fails to provide any parking provision to serve future occupiers of the development and would, therefore, encourage the displacement of vehicles onto the highway to the detriment of highway safety for both vehicles and pedestrian users. The development would therefore be contrary to the National Planning Policy Framework (2024), NPPF (2024), Policy DLP14 & DLP65 of the Dudley Local Plan and Dudley Councils’ Parking Standards SPD (2017) and Residential Design Guide (2023).
  3. Insufficient information has been submitted to consider the ecological impacts of the development contrary to the NPPF (2024), Policy DLP31 of the Dudley Local Plan and the councils Nature Conservation SPD (2016).
  4. Insufficient information has been provided to establish the baseline pre-development biodiversity value of the site and how the applicant intends to achieve the mandatory 10% biodiversity net gain requirements as set out within Schedule 7A of the Town and Country Planning Act 1990 (inserted by the Environment Act 2021). Refusal Statement Informative The Local Planning Authority is aware of the requirement of paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to occupier amenity, highway safety, ecological considerations, Biodiversity Net Gain requirements and the wider area that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
