The proposed development would result in a form of backland development that would be at odds with the prevailing pattern of linear development along the road frontage, to the detriment of the character and form of the surrounding area. As such the proposal is contrary to Policies DLP10, DLP11, DLP14 and DLP39 of the Dudley Local Plan (2026), the Residential Design Guide SPD (2023), and the guidance contained within the National Planning Policy Framework (2024).
The siting of the proposed dwellings would provide an inadequate living environment with poor privacy and private amenity space to the detriment of the residential amenity of future occupiers As such the proposed the proposal has failed to demonstrate that the quantum of development proposed could be accommodated on the site development such that it would be contrary to guidance within the National Planning Policy Framework (2024), the National Design Guide (2019), Policies DLP14 and DLP39 of the Dudley Local Plan (2026) and guidance within the Residential Design Guide SPD (2023).
The proposed fails to adequately demonstrate that it would be capable of providing sufficient access and parking provision such that it would not result in a detrimental impact on highways safety. Therefore the proposal is contrary to Policy DLP14 of the Dudley Local Plan (2026), the Parking Standards SPD (2017) and the National Planning Policy Framework (2024). Refusal Statement Informative The Local Planning Authority is aware of the requirement of paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to principle, amenity, access, parking and highway safety that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
