- The proposed advertisement, by virtue of its design, represents an unsympathetic and incongruous addition that fails to respect the character and appearance of the heritage asset and its wider setting within an Area of High Historic Townscape Value. The proposal would result in harm to the visual amenity of the street scene and would neither preserve nor enhance the historic character and distinctiveness of the area. As such, the development is contrary to guidance within the National Planning Policy Framework (2024), Policy ENV2 of the Black Country Core Strategy (2011), Policies S6, S8, S12 and D12 of the Dudley Borough Development Strategy (2017), the Shopfront and Advertisement SPD (2017) and Policies DLP54, DLP57 and DLP83 of the emerging Dudley Local Plan. INFORMATIVE The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to the impact on visual amenity that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
