The proposed change of use to an Adult Gaming Centre (Sui Generis) within the Stourbridge Town Centre Core Area would fail to accord with the defined role and function of the centre. The use does not fall within the acceptable main town centre uses set out under Policy DLP24 of the emerging Dudley Local Plan and would undermine the vitality and viability of the centre. As such, the proposal is contrary to Policy DLP24 of the emerging Dudley Plan.
The proposal fails to demonstrate that it would contribute positively to the physical, social and mental wellbeing of residents. In the absence of a submitted Health Impact Assessment, the development conflicts with Policy DLP8 of the emerging Dudley Local Plan, which seeks to manage the location and impacts of uses such as betting shops and amusement arcades. The proposal is therefore unacceptable in terms of its potential health and wellbeing impacts in accordance with Policy DLP8 of the emerging Dudley Local Plan.
The proposed shopfront alterations, by virtue of their modern design, materials, and lack of regard to established guidance, would result in a harmful and unsympathetic intervention that fails to preserve or enhance the character of the non-designated heritage asset and its setting within an Area of High Historic Townscape Value. The development is therefore contrary to the NPPF (2024), Policies ENV2 and ENV3 of the Black Country Core Strategy (2011), Policies S6, S8 and S12 of the Dudley Borough Development Strategy (2017) and Policies DLP39, DLP54 and DLP57 of the emerging Dudley Local Plan. INFORMATIVE The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to the acceptability of the proposed use within this location, its potential impacts on the health and wellbeing of residents, and the harm identified to the character and appearance of the non-designated heritage asset and wider townscape that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
