  1. Notwithstanding any of the details on the submitted application forms consent hereby granted for the works to the tree(s) is subject to the limitations specified in the schedule attached hereto. All works shall be carried out in accordance with the schedule and in compliance with British Standard BS 3998:2010 'Tree Work - Recommendations' Schedule: Crown reduce the tree without significantly altering its shape by a maximum of 3metres. Cuts are limited to a branch diameter of 100mm and are to be made back to a suitable outward facing side branch. Crown raise up to a height of 5-6 metres through the shortening or selected removal of secondary and tertiary branches only. No flush cuts or stub cuts are permitted in accord with BS3998:2010 Tree Works- Specified Limitations Informative It is a requirement of The Town and Country Planning Act 1990, that works to protected trees must be carried out in accordance with the details approved by the local planning authority. Under Section of 210 of the Town and Country Planning Act 1990, if any person contravenes the provisions of [F7a tree preservation order] [F7tree preservation regulations] otherwise than as mentioned in subsection (1), they shall be guilty of an offence and liable on summary conviction. REASON: To ensure that the visual amenity of the area is safeguarded.
  2. The tree works subject of this consent shall be carried out in accordance with British Standard BS 3998:2010 `Recommendations for Treework'. REASON: To ensure that the works are carried out in accordance with good arboricultural practices. INFORMATIVE This permission is valid for a period of no more than 2 Years from the date of the decision, unless a condition states otherwise. Similarly this permission relates to a one off undertaking of the approved works unless a condition states otherwise. Prior to any tree works being carried out it is recommended that the tree(s) are inspected to ascertain the presence of any legally protected species (in particular birds, bats and badgers) that are likely to be affected by the approved works. If any protected species are discovered advice should be sought from appropriate organisations (RSPB or Natural England). If the trees subject to this application are situated on land not owned by the applicant, the applicant will need to get permission from the relevant land owners to undertake works to any parts of the trees that does not encroach over their land. Applicants, tree owners and contractors should satisfy themselves that the documents that they are working to are the correct documents prior to commencing any works to protected trees.
