Under Section of 210 of the Town and Country Planning Act 1990, if any person contravenes the provisions of [F7a tree preservation order] [F7tree preservation regulations] otherwise than as mentioned in subsection (1), they shall be guilty of an offence and liable on summary conviction. Prior to any tree works being carried out it is recommended that the tree(s) are inspected to ascertain the presence of any legally protected species (in particular birds, bats and badgers) that are likely to be affected by the approved works. If any protected species are discovered advice should be sought from appropriate organisations (RSPB or Natural England). If the trees subject to this application are situated on land not owned by the applicant, the applicant will need to get permission from the relevant land owners to undertake works to any parts of the trees that does not encroach over their land. The decision documents, including the decision notice, photos and plans, relating to this application are available to view in the 'Planning Online' section of the Council's website (www.dudley.gov.uk).
