  1. The proposed alterations, including modern square-shaped windows above historic arched openings, flat-roofed additions, and extensive glazing, result in a visually discordant and unsympathetic design that fails to respect the character of the retained buildings. These elements cumulatively cause harm to the setting of the Brierley Hill High Street Conservation Area. The public benefits of reusing the site do not outweigh this harm. The proposal is therefore contrary to the NPPF, Policies S6, S8 and S9 of the Dudley Borough Development Strategy, Policies ENV2 and ENV3 of the Black Country Core Strategy, Policy 2 of the Brierley Hill Area Action Plan, the emerging Dudley Local Plan and Section 72 of the Planning (Listed Buildings and Conservation Areas) Act 1990. Refusal Statement Informative The Local Planning Authority is aware of the requirement of paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design, historic environment and the wider area that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
