  1. The proposal fails to provide sufficient parking to meet the parking demands of the development which raises substantial highway safety concerns in this location. There is limited space within the site for all types of vehicles accessing the site to safely manoeuvre onto the A459 with significant risk of pedestrian and vehicular conflict. The development would have a significant adverse impact on the transport network in highway safety terms and is contrary to the NPPF (2024) and Dudley Local Plan Policy DLP65 Transport Impacts of New Development and the Parking Standards Supplementary Planning Document (2017). Refusal Informative The Local Planning Authority is aware of the requirement of paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to [highways, amenity / design etc...] and the wider area that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
