The proposed development, by reason of its excessive density, scale, massing, irregular built form, layout and siting within a constrained and irregularly shaped plot, would result in a cramped, contrived and overly intensive form of development that would fail to respect or respond positively to the established character, appearance, layout and distinctiveness of the surrounding residential area. The proposal would therefore represent an incongruous and overdeveloped form of development that would be harmful to the character and appearance of the area, contrary to Policies L3 and DP3 of the National Planning Policy Framework (2026), Policies DLP4, DLP11, DLP14 and DLP39 of the Dudley Local Plan and the design principles contained within the Residential Design Guide SPD.
The proposed development, by reason of its scale, massing, design, layout and proximity to the common boundary with No. 2 Douglas Road, would result in unacceptable overlooking, loss of privacy, an overbearing relationship and harm to outlook for neighbouring occupiers. The proposal would therefore fail to provide an acceptable standard of residential amenity for existing neighbouring residents, contrary to Policies L2 and P3 of the National Planning Policy Framework (2026), Policies DLP11, DLP14 and DLP39 of the Dudley Local Plan and the Residential Design Guide SPD.
Insufficient information has been submitted to demonstrate that the proposed development can provide safe and suitable access arrangements and parking provision that accords with the Council's adopted parking standards, having regard to the significant level changes across the site and the likely requirement for engineering works and retaining structures. The proposal has therefore failed to demonstrate that adequate parking, vehicle manoeuvring facilities and safe access for all highway users can be achieved without detriment to highway safety, contrary to Policies TR3 and TR4 of the National Planning Policy Framework (2026), Policy DLP65 of the Dudley Local Plan and the Parking Standards SPD.
The application site lies within a high-risk coal mining area and within close proximity to known mine entries and historical shallow coal workings. In the absence of a Coal Mining Risk Assessment, insufficient information has been submitted to demonstrate that the site is suitable and safe for the proposed development, or that risks associated with past coal mining activities can be adequately assessed and mitigated. The proposal is therefore contrary to Policy P2 of the National Planning Policy Framework (2026) and Policy DLP80 of the Dudley Local Plan.
Insufficient information has been submitted to demonstrate how existing habitats would be retained, enhanced or replaced, and to demonstrate that the development would achieve the statutory biodiversity gain objective, including the mandatory minimum 10% Biodiversity Net Gain. Consequently, the Local Planning Authority cannot be satisfied that the proposal would secure measurable biodiversity improvements in accordance with Schedule 7A of the Town and Country Planning Act 1990 (as amended by the Environment Act 2021), Policies N2 and N3 of the National Planning Policy Framework (2026) and Policy DLP32 of the Dudley Local Plan. Refusal Statement Informative The Local Planning Authority has worked with the applicant in a positive and proactive manner in accordance with Policy DM3 of the National Planning Policy Framework. However, following a balanced assessment of the proposal, it is considered that there are fundamental concerns relating to the design and layout of the development, its impact on neighbouring residential amenity, highway and parking provision, land stability and the lack of sufficient information to demonstrate compliance with biodiversity net gain requirements. These matters have not been satisfactorily addressed and the proposal is therefore considered to constitute an unsustainable form of development for which planning permission cannot be granted.
