The extension, by virtue of its size, would result in a disproportionate and incongruous addition to the existing dwelling which would cause undue harm to the character and appearance of the dwelling. As such, the proposal fails to comply with the relevant requirements of the National Planning Policy Framework (2024), Policy ENV3 of the Black Country Core Strategy (2011), Policies S6 and L1 of the Dudley Borough Development Strategy (2017), Emerging Policies DLP14 and DLP39 of the Dudley Local Plan (Examination Stage), and the advice contained within the Residential Design Guide Supplementary Planning Guidance (2023).
The extension, by virtue of its size and siting, would result in a loss of light to the habitable rooms of the neighbouring dwelling of No.20 Northfield Road which would cause undue harm to the amenity of the occupants of the dwelling. Furthermore, the extension would have an overbearing impact upon the occupants of the neighbouring dwellings resulting in undue harm to the occupants using the private amenity area of No.18 and No.20 Northfield Road. In addition, the side windows on both elevations, by virtue of their location, would overlook the private amenity space of the neighbouring dwellings and cause undue harm to the amenity of the occupants of No.18 and No.20 Northfield Road. As such, the proposal would be contrary to the relevant requirements of the National Planning Policy Framework (2024), Policy ENV3 of the Black Country Core Strategy (2011), Policies S6 and L1 of the Dudley Borough Development Strategy (2017), Emerging Policies DLP14 and DLP39 of the Dudley Local Plan (Examination Stage), and the advice contained within the Residential Design Guide Supplementary Planning Guidance (2023). Informative: The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
