Planning conditions
  1. The commencement of the extended operations hereby approved shall not be undertaken until the 2.4m high acoustic noise barrier with a minimum surface density of 10 kg/m2, as shown in drawing No.Plan 25-566-SK01 REV E is constructed along the boundary of the site with Fairfield Park (excluding the site entrance/exit point). This barrier shall thereafter be retained throughout the life of the development. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 79 and 81 contained within the emerging Dudley Local Plan.
  2. Adequate facilities for the treatment of grit, dust, fume, gas or mist and for their extraction shall be provided to the satisfaction of the Local Planning Authority at all times during the duration of the development hereby permitted. REASON: To minimise the impacts to air quality associated with the development and to protect the health and well-being of residents in accordance with BCCS Policy ENV8 - Air Quality.
  3. The development hereby permitted shall be carried out in accordance with the following approved plans: Site Location Plan and Plan 25-566-SK01 Rev E REASON: For the avoidance of doubt and in the interests of proper planning.
  4. The development shall operate in accordance with the Lighting Impact Assessment prepared by Mewies Engineering Consultants Ltd, dated May 2022. No floodlighting shall be used between the hours of 23:00 and 07:00 on any day. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 79 and 81 contained within the emerging Dudley Local Plan.
  5. No external loading or unloading of vehicles shall be permitted outside of the hours of 0600 to 2330 on Mondays, 0530 to 2330 on Tuesday-Friday and 0700 to 1900 on Saturdays. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 79 and 81 contained within the emerging Dudley Local Plan.
  6. No fixed plant and/or machinery shall be operated externally on the premises outside of the hours of 0700 to 1800 on Saturdays, 0600 to 2330 on Mondays, 0530 - 2330 on Tuesdays to Fridays or at no time on Sundays or Bank Holidays. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 79 and 81 contained within the emerging Dudley Local Plan.
  7. No more than five Heavy Goods Vehicles (HGVs) shall enter or leave the site between the hours of 04:30 and 06:00 on Mondays, and between 04:30 and 05:30 on Tuesdays to Fridays. No HGV movements shall occur during these hours on Saturdays, and at no time on Sundays, or Public Holidays. A log of HGV movements during these restricted hours shall be maintained and made available to the Local Planning Authority upon request. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 79 and 81 contained within the emerging Dudley Local Plan.
  8. The Noise Management Plan (NMP), original version dated November 2025, shall be adhered to, maintained and reviewed annually. The NMP shall also be reviewed in the event of any significant changes to activities at the premises and/or in the event of complaints being received that result in identification of further noise control measures or remedial actions required. The Noise Management Plan (NMP) shall include provision for signage to be erected and maintained in the external service yard notifying drivers: • That the area is noise sensitive • The permitted delivery/external operational hours and limit of 5 HGVs leaving the site between 0430 to 0600 Mondays and 0430 to 0530 Tuesday to Friday. • The need to switch off vehicle engines outside the working hours • Instructions to drivers that cab entertainment shall not be used whilst vehicles are on site and leaving the site along Fairfield Park during noise sensitive hours of 2300 to 0700. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 79 and 81 contained within the emerging Dudley Local Plan.
  9. The shutter entrance door to unit 4 shall remain fully closed between the hours of: 2330 to 0600 on any day, except to allow the egress of up to 5 HGVs between 0430 to 0600 on Mondays and between 0430 to 0530 on Tuesdays to Fridays and in the case of emergency access. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 79 and 81 contained within the emerging Dudley Local Plan.
  10. The premises shall be used for Class B2 and Class B8 uses in accordance with the Town and Country Planning (Use Classes) Order 1987. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 79 and 81 contained within the emerging Dudley Local Plan.
  11. The commencement of the extended operations hereby approved shall not be undertaken until visibility splays to the accesses have been provided at the junction between the proposed means of access and the highway with an 'x' set back distance of 2 metres and a 'y' distance of 2 metres. No structure or vegetation exceeding 600mm in height above the adjoining highway shall be placed or allowed to grow within the visibility splay for the life of the development unless otherwise agreed in writing by the Local Planning Authority. REASON: In the interests of highway safety and to comply with Policies TRAN2 and TRAN5 of the Black Country Core Strategy, Policies S17 of the Dudley Borough Development Strategy 2017, and Policies DLP 65 contained within the emerging Dudley Local Plan.
  12. No fixed plant and/or machinery shall be operated internally outside of the hours of 0430 on Mondays to 2330 on Fridays (inclusive) or 0700 - 1800 on Saturdays and at no time on Sundays or Bank Holidays. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 79 and 81 contained within the emerging Dudley Local Plan.
  13. The rating level of sound emitted from any fixed plant and/or machinery associated with the development and industrial activities at the use hereby approved shall not exceed background sound levels by more than 5dB(A) between the hours of 0700-2300 (taken as a 15 minute LA90 at the nearest sound sensitive premises) and shall not exceed the background sound level between 2300-0700 (taken as a 15 minute LA90 at the nearest /any sound sensitive premises). All measurements shall be made in accordance with the methodology of BS4142 (2014) (Methods for rating and assessing industrial and commercial sound) and/or its subsequent amendments. Where access to the nearest sound sensitive property is not possible, measurements shall be undertaken at an appropriate location and corrected to establish the noise levels at the nearest sound sensitive property. Any deviations from the LA90 time interval stipulated above shall be agreed in writing with the local planning authority. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 79 and 81 contained within the emerging Dudley Local Plan. Approval Statement Informative In dealing with this application the Local Planning Authority have worked with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application, by seeking to help the applicant resolve technical detail issues where required and maintaining the delivery of sustainable development. The development would improve the economic, social and environmental concerns of the area and thereby being in accordance with paragraph 39 of the National Planning Policy Framework 2024. IMPORTANT - COMMUNITY INFRASTRUTURE LEVY This development is exempt from the Community Infrastructure Levy (CIL) and therefore you are only required to comply with the conditions attached to this notice.
