Planning conditions
  1. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), or any Order revoking, re-enacting or modifying that Order, the first floor accommodation shall not be occupied or used for any commercial, storage, office, retail, residential or other operational purpose, and shall remain permanently unoccupied. REASON: The upper floor accommodation has not been assessed as part of the approved development and its occupation or use would be likely to result in additional activity, parking demand and traffic generation, to the detriment of residential amenity and highway safety in accordance with Policies S1, S17, D2 and D5 of the Dudley Borough Development Strategy and Policies TRAN2 and TRAN5 of the Black Country Core Strategy, and Policies DLP 65, DLP 78, DLP 81 and DLP 82 of the emerging Dudley Local Plan.
  2. The premises shall not be open to the public before the hours of 0700 nor after 2200 on any day. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 78 and 81 contained within the emerging Dudley Local Plan.
  3. No deliveries or despatches shall be made to or from the site, and no delivery or despatch vehicles shall enter or leave the site (whether laden or unladen), before the hours of 0700 nor after 1800 Monday to Saturday, or before 0900 or after 1300 on Sundays and Public Holidays. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 78 and 81 contained within the emerging Dudley Local Plan.
  4. The rating level of sound emitted from any fixed plant and/or machinery associated with the development shall not exceed background sound levels by more than 5dB(A) between the hours of 0700-2300 (taken as a 15 minute LA90 at the nearest sound sensitive premises) and shall not exceed the background sound level between 2300-0700 (taken as a 15 minute LA90 at the nearest /any sound sensitive premises). All measurements shall be made in accordance with the methodology of BS4142 (2014) (Methods for rating and assessing industrial and commercial sound) and/or its subsequent amendments. Where access to the nearest sound sensitive property is not possible, measurements shall be undertaken at an appropriate location and corrected to establish the noise levels at the nearest sound sensitive property. Any deviations from the LA90 time interval stipulated above shall be agreed in writing with the local planning authority. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and Policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 78 and 81 contained within the emerging Dudley Local Plan.
  5. Work shall not begin on the demolition and construction of the development until a method statement for the control of dust and emissions arising from the demolition and construction of the development has been submitted to and approved by the local planning authority. All works which form part of the approved scheme shall be implemented throughout the construction and demolition phase of the development. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 78 and 81 contained within the emerging Dudley Local Plan.
  6. Demolition or construction works shall only take place between the hours of 0700 hours and 1800 hours Mondays to Fridays, 0800 hours to 1700 hours on Saturdays and not at any time on Sundays or Public Holidays. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and policies D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 78 and 81 contained within the emerging Dudley Local Plan.
  7. No part of the development shall be brought into use until the off-site highway works comprising the pedestrian crossing and splitter island alterations have been completed and available for use through a S278 agreement and implemented in accordance with an approved programme. REASON: In the interests of highway safety and to comply with Policies, DEL1, TRAN2 and TRAN4 of the Black Country Core Strategy and Policy S17 of the Dudley Borough Development Strategy and Policies DLP 6, DLP 65 and DLP 67 of the emerging Dudley Local Plan.
  8. The development shall not be occupied/used until details of secure and covered staff cycle storage have been submitted to and approved in writing by the Local Planning Authority. These facilities shall be provided in accordance with the approved details prior to the first use/occupation of the development and shall thereafter be retained and maintained for no other purpose for the life of the development. REASON: In the interests of highway safety and to comply with Borough Development Strategy 2017 Policy S6, S17 and D2 (in part) and policies CSP5, DEL1, TRAN2 and TRAN5 of the Black Country Core Strategy, and Policies DLP 6, DLP 39, DLP 65 and DLP 67 of the emerging Dudley Local Plan.
  9. The development shall not be first occupied/used until details of the bin stores have been submitted to and approved in writing by the Local Planning Authority. The bin stores shall be provided in accordance with the approved details prior to the first use/occupation of the development and shall thereafter be retained and maintained for no other purpose for the life of the development. REASON: In the interests of highway safety and to comply with Borough Development Strategy 2017 Policy S6, S17 and D2 (in part) and policies CSP5, DEL1, TRAN2 and TRAN5 of the Black Country Core Strategy, and Policies DLP 6, DLP 39, DLP 65 and DLP 67 of the emerging Dudley Local Plan.
  10. The premises shall be used only for purposes falling within Class E(a) (retail sale of goods, other than hot food), and Class E (e) (Vets and Tanning Studio) of the Town and Country Planning (Use Classes) Order 1987 (as amended), or in any provision equivalent to that Class in any statutory instrument revoking and re-enacting that Order, and for no other purpose, including any other use within Class E. REASON: To ensure the development operates in a manner appropriate to its location, to safeguard the amenities of the area and In the interests of highway safety, in accordance with Policies S1, S17, D2 and D5 of the Dudley Borough Development Strategy and Policies TRAN2 and TRAN5 of the Black Country Core Strategy, and Policies DLP 65, DLP 78, DLP 81 and DLP 82 of the emerging Dudley Local Plan.
  11. The development hereby permitted shall not be first occupied until a lighting scheme with assessment for the minimisation of the effect of light spillage on properties has been submitted to and approved in writing by the Local Planning Authority. The works in the approved scheme shall be completed before any lighting equipment to which this approval relates is operated, and shall be maintained during such operation for the life of the development. REASON: To protect the amenities of nearby residents in accordance with Paragraph 198 of the NPPF and policy D6 of the Dudley Borough Development Strategy, and Policy DLP 82 contained within the emerging Dudley Local Plan.
  12. The boundary treatments hereby permitted shall be carried out in complete accordance with the approved details prior to the occupation of the development hereby approved and shall thereafter be retained for the lifetime of the development. REASON: To protect the amenities of nearby resident and In order to make a positive contribution to place-making and provide a high quality public realm in accordance with Policies CSP4 , ENV2, ENV3 and DEL1 of the Black Country Core Strategy, and Policies S6, S8, D2 and D5 of the Dudley Borough Development Strategy, and Policies DLP 4, DLP 6, DLP 39, DLP54, DLP 78 and 81 contained within the emerging Dudley Local Plan.
  13. The development hereby permitted shall be carried out in accordance with the following approved plans: THPW 00 XX DR A 1001 P02, THPW 00 XX DR A 1002 P02, THPW 00 XX DR A 1003 P01, THPW 00 XX DR A 1004 P01, THPW 00 XX DR A 1005 P01, THPW XX XX DR A 1006 P01, THPW 00 XX DR A 1020 P01, THPW 00 XX DR A 1025 P01, THPW XX XX DR A 1031 P02, THPW 00 XX DR A 1032 P01. REASON: For the avoidance of doubt and in the interests of proper planning.
  14. The development hereby permitted shall be begun before the expiration of three years from the date of this permission. REASON: To comply with Section 91(1) of the Town and Country Planning Act, 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
  15. The development hereby permitted shall not be first occupied until a landscape strategy for the site has been submitted to and approved in writing by the Local Planning Authority. The strategy shall include a timetable for the implementation of the works and their ongoing maintenance, and shall be implemented in accordance with the approved details and shall thereafter be retained and maintained for no other purpose for the life of the development. REASON: In order to make a positive contribution to place-making and provide a high quality landscaping in accordance with Policies CSP4, ENV2, ENV3 and DEL1 of the Black Country Core Strategy, and Policies S6, S7 and D2 and Policies DLP 4, DLP 6, DLP 39, DLP54 contained within the emerging Dudley Local Plan.
  16. The development shall not be first occupied until the approved parking, turning and manoeuvring areas shown on the approved plans have been laid out in accordance with the approved plans and shall thereafter be retained and kept available for the parking, turning and manoeuvring of vehicles associated with the development. REASON: In the interests of highway safety and to comply with Policies, DEL1, TRAN2 and TRAN4 of the Black Country Core Strategy and Policy S17 of the Dudley Borough Development Strategy and Policies DLP 6, DLP 65 and DLP 67 of the emerging Dudley Local Plan.
  17. Prior to first occupation of the development, a Delivery and Servicing Management Plan shall be submitted to and approved in writing by the Local Planning Authority. The Plan shall include: delivery vehicle sizes; delivery routes; arrangements for servicing and refuse collection; management of deliveries where parking bays are temporarily unavailable for customer use; measures to prevent obstruction of the internal access roads and public highway. The approved Delivery and Servicing Management Plan shall be implemented upon first occupation and adhered to thereafter for the lifetime of the development. REASON: To ensure the development operates in a manner appropriate to its location, to safeguard the amenities of the area and in the interests of parking and highway safety, in accordance with Policies S1, S6, S17, D2 and D5 of the Dudley Borough Development Strategy and Policies CSP1, CSP5, DEL1, TRAN2 and TRAN5 of the Black Country Core Strategy, and Policies DLP 6, DLP 39, DLP 65, DLP 78 and DLP 81 of the emerging Dudley Local Plan.
  18. The development shall not be first occupied until the access and egress points have been laid out in accordance with the approved plans and shall thereafter be retained as approved for the lifetime of the development. REASON: In the interests of highway safety and to comply with DEL1, TRAN2 and TRAN4 of the Black Country Core Strategy and Policy S17 of the Dudley Borough Development Strategy and Policies DLP 6, DLP 65 and DLP 67 of the emerging Dudley Local Plan.
  19. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), no mezzanine floor or additional trading floorspace shall be inserted within the building without the prior written approval of the Local Planning Authority. REASON: To ensure the development operates in a manner appropriate to its location, to safeguard the amenities of the area and in the interests of parking and highway safety, in accordance with Policies S1, S17, D2 and D5 of the Dudley Borough Development Strategy and Policies TRAN2 and TRAN5 of the Black Country Core Strategy, and Policies DLP 65, DLP 78, DLP 81 and DLP 82 of the emerging Dudley Local Plan.
  20. The development shall not be first occupied until the electric vehicle charging facilities shown on the approved plans have been installed and made available for use. The facilities shall thereafter be retained and maintained for the lifetime of the development. REASON: In the interests of creating a sustainable form of development and to encourage the use of ultra low emission vehicles in accordance with Policies ENV8 (Air Quality) and DEL1 (Infrastructure Provision) of the Black Country Core Strategy and Policy DLP 6 of the emerging Dudley Local Plan.
  21. No development shall commence until details of measures to ensure that all vehicles exiting the site at the Long Lane access turn left only onto Long Lane have been submitted to and approved in writing by the Local Planning Authority. The approved measures shall be implemented in full prior to the first use of the development and shall thereafter be retained and maintained for the lifetime of the development. REASON: In the interests of highway safety and to comply with the NPPF and Policies DLP6, DLP65 and DLP67 of the Dudley Local Plan. Approval Statement In dealing with this application the Local Planning Authority have worked with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application, by seeking to help the applicant resolve technical detail issues where required and maintaining the delivery of sustainable development. The development would improve the economic, social and environmental concerns of the area and thereby being in accordance with paragraph 39 of the National Planning Policy Framework 2024. Important - Community Infrastructure Levy: This development is exempt from the Community Infrastructure Levy (CIL) and therefore you are only required to comply with the conditions attached to this notice.
