Planning conditions
  1. The proposal, by reason of its unsympathetic, overtly modern and incongruous design, would fail to assimilate with the host dwelling and would cause demonstrable harm to the character and visual amenity of the host dwelling and wider streetscene which would prejudice a key view into a Conservation Area, contrary to Policies ENV2 and ENV3 of the Black Country Core Strategy, Polices L1, S6, S8 and S9 of the Dudley Borough Development Strategy and the Residential Design Guide SPD.
  2. The proposal would fail to protect the amenities of neighbouring residential properties due to a breach of the 45-degree code in regard to neighbour 29 Corser Street which would cause demonstrable harm in terms of loss of light and outlook contrary to Policy ENV3 of the Black Country Core Strategy, Policy L1 of the Dudley Borough Development Strategy and Residential Design Guide SPD. Refusal Statement Informative The Local Planning Authority is aware of the requirement of paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design and neighbouring amenity and the wider area that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area
