The proposed rear dormer would be an incongruous addition which would dominate the rear roof plane and would be out of keeping with the design of the existing building to the detriment of the character and appearance of the area contrary to the National Planning Policy Framework (2024); Policies ENV2, ENV3, HOU1 & HOU2 of the Black Country Core Strategy (2011); Policies S6, S8 and L1 of the Dudley Borough Development Strategy (2017); Policies DLP10, DLP11, DLP14, DLP39, DLP55, of the emerging Dudley Local Plan; and the guidance contained within the Residential Design Guide SPD (2023).
The proposed development would provide substandard internal accommodation for future occupiers of the self-contained flat contrary to the requirements of the NPPF, Policy L1 of the Dudley Borough Development Strategy, Policy DLP14 of the emerging Dudley Local Plan, the Council's Residential Design SPD & Technical Housing Standards (DCLG 2015).
The proposed rear dormer would introduce a roof level bedroom window which would overlook the private rear garden of 8 Lyndon Grove resulting in a loss of privacy to the detriment of neighbouring amenity contrary to the NPPF, Policy L1 of the Dudley Borough Development Strategy, policy DLP14 of the Emerging Dudley Local Plan & the council's adopted Residential Design Guide (2023).
The proposed development would significantly increase the residential accommodation within the site and no parking is proposed. The non-provision of parking in this location raises unacceptable highway safety concerns contrary to the NPPF (2024), Policy TRAN2 of the Black Country Core Strategy, Policy S17 of the Dudley Borough Development Strategy, Policy DLP17 & DLP69 of the emerging Dudley Local Plan and Dudley Councils' Parking Standards SPD (2017), Residential Design Guide (2023). Refusal Statement Informative The Local Planning Authority is aware of the requirement of paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design, occupier amenity, neighbouring amenity, highway safety and the wider area that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
