Decision Notice
Planning conditions
  1. Insufficient information has been submitted to demonstrate that the proposed dropped kerb would provide a safe and suitable means of vehicular access to the public highway. In particular, no details have been provided in relation to the visibility splays, access layout, or on-site turning in manoeuvring arrangements to demonstrate that vehicles could enter and leave the site in a safe manner and in a forward gear. In the absence of this information the Local Planning Authority cannot be satisfied that the proposal would not result in harm to highway safety or adversely affect the safe movement of vehicles, cyclists and pedestrians using the adjoining highway. The proposal has therefore failed to comply with the National Planning Policy Framework (2024), Policy TRAN2 of the Black Country Core Strategy (2011), Policy S17 of the Dudley Borough Development Strategy (2017), the Dudley Parking Standards Supplementary Planning Document (2017) and the relevant policies within the emerging Dudley Local Plan. The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to highway safety that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
