The proposed development would result in the total loss of a non-designated heritage asset, causing significant harm to the historic character and distinctiveness of the locality. The replacement dwellings are not of high-quality design and would appear out of character and incongruous within their context that is exacerbated by their scale and poor garden layout, failing to outweigh and mitigate the total loss of the heritage asset or enhance the character of the area. As such, the proposal is contrary to guidance within the National Planning Policy Framework (2024), Policies ENV2 and ENV3 of the Black Country Core Strategy, Policies L1, S6 and S8 of the Dudley Borough Development Strategy (2017), the Historic Environment SPD (2017), the Residential Design Guide SPD (2023) and emerging Dudley Local Plan Policies DLP39 and DLP55.
The proposal fails to provide adequate parking, manoeuvring space, and access to safely accommodate the proposed development. This would likely result in vehicles being displaced onto the public highway or unable to access the highway in a forward gear to the detriment of highway safety. The development is therefore contrary to the National Planning Policy Framework (2024), Policy TRAN2 of the Black Country Core Strategy (2011), Policies S17 and L1 of the Dudley Borough Development Strategy (2017), the Parking Standards SPD (2017) and Policy DLP69 of the emerging Dudley Local Plan.
The proposed development would fail to secure adequate and good quality residential accommodation to serve the future occupiers by reason of its inadequate garden layout. As such the proposed development is contrary to guidance contained within the National Planning Policy Framework (2024) and Policy L1 of the Dudley Borough Development Strategy (2017), the Residential Design Guide SPD (2023) and Policy DLP39 of the emerging Dudley Local Plan.
The proposed development by reason of its siting and relationship with No. 118a Amblecote Road would result in a detrimental impact on the amenity of the neighbouring occupier in regard to privacy. As such the proposed development is contrary to guidance contained within the National Planning Policy Framework (2024) and Policy L1 of the Dudley Borough Development Strategy (2017), the Residential Design Guide SPD (2023) and Policy DLP39 of the emerging Dudley Local Plan. Refusal Statement Informative The Local Planning Authority is aware of the requirement of paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to the loss of a non-designated heritage asset, design, occupier amenity, neighbouring amenity and highway safety that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
