The proposed first-floor side extension, by virtue of its bulk, massing, and siting, would result in a dominant and incongruous addition to the existing dwelling which would cause harm to the character and appearance of the street scene. Furthermore, by virtue of its bulk, massing, and siting, the first-floor side extension would breach the 45-degree rule from the habitable rooms of the neighbouring dwelling and would result in an unacceptable level of harm to the amenity of the occupants of 62 Oakham Road with special regard to the loss of light to the ground floor habitable room, loss of outlook, and overbearing impact. The proposal therefore fails to comply with the requirements of the National Planning Policy Framework (2024), Policy ENV3 of the Black Country Core Strategy (2011), Policies S6 and L1 of the Dudley Borough Development Strategy (2017), Emerging Policies DLP14 and DLP39 of the Dudley Local Plan (Examination Stage), and the advice contained within the Residential Design Guide Supplementary Planning Guidance (2023). Informative: The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
