The boundary treatment, by reason of its height, design and siting, would obstruct visibility splays required for the safe access and egress of vehicles from the adjacent off-street parking spaces. This would result in inadequate intervisibility between drivers and other highway users, giving rise to an unacceptable impact on highway safety. As such, the development is harmful to public safety and is contrary to the guidance contained within the National Planning Policy Framework (2024), policies TRAN2 of the Black Country Core Strategy (2011), policies S17 and L1 of the Dudley Borough Development strategy, policies DLP14 and DLP69 of the emerging Dudley Local Plan. Refusal Statement Informative The Local Planning Authority is aware of the requirements of paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers consider that there are insurmountable technical issues relating to highways and character and the wider area that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
The proposed development, by reason of its scale, siting and visual prominence on this corner plot, would result in an overly dominant and incongruous form of development that would erode the spatial openness of the corner. This openness forms a characteristic and deliberate feature of the local street scene, and its enclosure would harm the distinctiveness and character of the area. The proposal therefore fails to respond positively to its surroundings and is contrary to principles contained within the NPPF (2024), Dudley Borough Development Strategy (2017) Policies L1 and S6, Policy ENV3 of the Black Country Core Strategy (2011) and policy DLP14 and DLP39 of the emerging Dudley Local Plan.
