  1. The proposed two-storey side and rear extension, by virtue of its size, bulk, and massing, would be a dominant and disproportionate addition to the existing dwelling which would cause harm to the character and appearance of the existing dwelling. Furthermore, the addition would unbalance the pair of semi-detached dwellings which would cause harm to the character and appearance of the street scene and surrounding area. The proposal therefore fails to comply with the requirements of the National Planning Policy Framework (2024), Policy ENV3 of the Black Country Core Strategy (2011), Policies S6 and L1 of the Dudley Borough Development Strategy (2017), Emerging Policies DLP14 and DLP39 of the Dudley Local Plan (Examination Stage), and the advice contained within the Residential Design Guide Supplementary Planning Guidance (2023). Informative: The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework (2024) to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
