Decision Notice PINS - Appeal Decision
Planning conditions
  1. The proposed development would have a negative impact upon the openness of the corner plot, the host dwelling and the character of the surrounding area. Therefore, the proposed development is contrary to the National Planning Policy Framework (2024), Policy ENV3 of the BCCS, Policy L1 of the Dudley Borough Development Strategy and The Residential Design Guide (2023). Refusal Statement The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, there are insurmountable technical issues relating to the design that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
