The proposed development, by virtue of its siting, scale, massing and poor design, would result in an overly dominant and visually intrusive form of development that fails to respect the character, appearance of the host building and surrounding area. The extension would appear as a prominent and competing addition, overwhelming the existing building, which is identified as a non-designated heritage asset, and detracting from its contribution to the Area of High Historic Townscape Value. The proposed development is therefore contrary to guidance within the National Planning Policy Framework (2024), policy ENV2, ENV3 and CSP4 of the Black Country Core Strategy (2011), policy L1, S6, S8 and S12 of the Dudley Borough Development Strategy (2017), the Residential Design Guide (2023) and policies DLP4, DLP14, DLP39, DLP55 and DLP59 of the emerging Dudley Local Plan.
The proposed extension by reason of its breach of the 45 degree code, loss of windows, siting and scale would have a detrimental impact on the habitable room windows of the existing neighbouring occupier in regard to outlook and light. The proposal would be contrary to guidance contained within the National Planning Policy Framework (2024), policy L1 of the Dudley Borough Development Strategy (2017), the Residential Design Guide SPD (2023) and policy DLP14 of the emerging Dudley Local Plan. Refusal Statement Informative The Local Planning Authority is aware of the requirement of paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to the design, impact on character and impact on neighbouring amenity that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
