Planning conditions
  1. The use of the external sound amplification equipment, including any amplification from televisions, shall be permitted for a limited duration of 1 calendar year. The date of the start of this 1 calendar year duration shall only commence upon the written notification by the applicant of such to the Local Planning Authority. From the date of this permission to the written notification and following the end of the 1 calendar year no external sound amplification equipment, including any amplification from televisions, shall be used. REASON: To enable the Local Planning Authority to assess the impact of the sound amplification equipment, including the noise from the televisions in accordance with Policy D2 Incompatible uses, D5 Noise Pollution and D6 Light Pollution of the Dudley Borough Development Strategy and ENV7 of the Black Country Core Strategy. Informatives: Approval Statement Informative In dealing with this application the Local Planning Authority have worked with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application, by seeking to help the applicant resolve technical detail issues where required and maintaining the delivery of sustainable development. The development would improve the economic, social and environmental concerns of the area and thereby being in accordance with paragraph 39 of the National Planning Policy Framework 2024. IMPORTANT - COMMUNITY INFRASTRUTURE LEVY This development is exempt from the Community Infrastructure Levy (CIL) and therefore you are only required to comply with the conditions attached to this notice.
  2. The development hereby permitted shall be carried out in accordance with the following approved plans: Amended Location, Site and Elevation Plans (as submitted on the 26/11/2025) REASON: For the avoidance of doubt and in the interests of proper planning.
  3. The beer garden shelter hereby permitted shall not be occupied at any time other than for purposes ancillary to the host premises known as The Swan Inn as a public house, and these facilities shall not be utilised, sold or let separately from the main premises without the express grant of planning permission. REASON: In the interests of occupier amenity, and to ensure there is no shortfall in car parking in accordance with BCCS Policy TRAN2 and Borough Development Strategy 2017, Policies L1, D5 and Policy D2 (in part).
  4. The beer garden shelter hereby approved shall not be used before 10:00 hours or after 22:00 hours on any day of the week. REASON: To protect the amenities of the surrounding residents in accordance with Borough Development Strategy 2017 Policy D5 Noise Pollution and Policy L1 Housing Development, extensions and alterations to existing dwellings and Policy D2 Incompatible Land Uses (in part).
  5. Within a period of 1 month, a lighting scheme for the approved garden shelter which minimises of the effect of light spillage on nearby properties shall be submitted to the Local Planning Authority for approval. The approved lighting scheme shall be implemented within a period of one month of its approval, and this shall be maintained during its operation for the life of the development. REASON: In order to safeguard amenity in respect of possible adverse effects of lighting glare in compliance with Borough Development Strategy 2017 Policies D6 Light Pollution, Policy L1 Housing Development, extensions and alterations to existing dwellings and Policy D2 Incompatible Land Uses (in part).
