Planning conditions
  1. The Local Planning Authority is not satisfied, on the balance of probability, that the proposed structure meets the statutory definition of a “caravan” under Section 29(1) of the Caravan Sites and Control of Development Act 1960 and Section 13 of the Caravan Sites Act 1968. In the absence of sufficient and precise information, the Local Planning Authority cannot be satisfied that the structure would be capable of being moved as required by the legislation. In accordance with Planning Practice Guidance, the application therefore fails to demonstrate lawfulness, and a Certificate of Lawfulness under Section 192 cannot be issued.
