Planning conditions
  1. The applicant has failed to demonstrate an identified need for the proposed day care facility and supported living accommodation, nor has it been shown that the development would be appropriately integrated with existing community services, accessible by sustainable transport modes, or located where an established gap in provision exists. As such, the proposal does not meet the requirements of Policies HOU5 of the Black Country Core Strategy and L2 of the Dudley Borough Development Strategy, and therefore fails to comply with the principles of sustainable development as outlined within the National Planning Policy Framework.
  2. The proposed development, by reason of its intensity of use and the associated increase in vehicle movements, activity levels and operational noise, particularly during noise sensitive hours, would result in an unacceptable level of noise and disturbance to neighbouring occupiers. The submitted Noise Impact Assessment fails to adequately assess or mitigate night time impacts. The proposal therefore conflicts with Policies L2 and D2 of the Dudley Borough Development Strategy, which seek to protect the amenity of existing residential properties.
  3. The proposal fails to provide adequate parking provision, safe and inclusive pedestrian access, or suitable on site manoeuvring arrangements. The development would lead to unsafe reversing movements onto Church Road and would exacerbate existing congestion and conflict between vehicles and pedestrians in an already constrained environment. The proposal therefore results in an unacceptable impact on highway safety, contrary to the National Planning Policy Framework and Policies TRAN2 of the Black Country Core Strategy and S17 of the Dudley Borough Development Strategy, as well as the guidance contained within the Council's Parking Standards SPD. The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to its use, amenities and highway safety that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
