The proposed development, due to its scale, massing, design and visual prominence, would form a discordant and incongruous addition to the existing dwelling which would result in a detrimental impact upon the character and appearance of the host property, the character and symmetry of the neighbouring semi-detached dwelling and the visual amenity of the surrounding area. As such the proposed development is contrary to the National Planning Policy Framework (2024), Policies ENV2 and ENV3 of the Black Country Core Strategy (2011), Policies S6, S8 and L1 of the Dudley Borough Development Strategy (2017) and the Residential Design Guide SPD (2023).
The proposed development, due to its scale and close proximity, would breach the Councils adopted 45 Degree Code and would have an adverse impact upon the residential amenity of the adjoining neighbours at 1 Corbyns Hall Road where there would be an overbearing impact upon their immediate outlook and significant loss of light. Furthermore, the proposed development would appear unduly overbearing when viewed from the rear facing habitable room windows and the primary area of amenity space to the rear of 1 Corbyns Hall Road to the detriment of neighbouring amenity. As such the proposed development is contrary to the National Planning Policy Framework (2024), Policy ENV2 of the Black Country Core Strategy (2011), Policies S6, S8 and L1 of the Dudley Borough Development Strategy (2017) and the Residential Design Guide SPD (2023). The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to scale, massing and design and impact to neighbouring amenity that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
