Insufficient information has been provided regarding the nature and operation of the proposed use(s), including whether a material change of use is proposed. Consequently, the Local Planning Authority is unable to determine whether the development would accord with the objectives of safeguarding Local Quality Employment Areas for appropriate employment uses. In the absence of this information, it has not been demonstrated that the proposal would not undermine the function, viability and attractiveness of the employment area. The proposal is therefore contrary to Policy EMP3 of the Black Country Core Strategy and Policy L7 of the Dudley Borough Development Strategy and the relevant policies contained within the emerging Dudley Local Plan.
The application is not supported by a Heritage Statement or any assessment of the significance of the site or its contribution to the designated Area of High Historic Townscape Value. As such, the Local Planning Authority is unable to assess the impact of the proposed development on the character, appearance and historic significance of the area. The proposal has therefore failed to demonstrate that it would preserve or enhance the character and setting of the heritage asset, contrary to Policy ENV2 of the Black Country Core Strategy, Policy S12 of the Dudley Borough Development Strategy and the relevant policies contained within the emerging Dudley Local Plan.

It has not been demonstrated that the development would safeguard residential amenity. The proposal is therefore contrary to Policies D2, D5 and D6 of the Dudley Borough Development Strategy and the relevant policies contained within the emerging Dudley Local Plan.
Insufficient information has been provided regarding access arrangements, parking provision, servicing, and vehicle movements associated with the proposed development. In the absence of such information, the Local Planning Authority cannot be satisfied that safe and suitable access for all users can be achieved, nor that the development would not result in on-street parking displacement or harm to the safe and efficient operation of the highway network. The proposal is therefore contrary to Policy TRAN2 of the Black Country Core Strategy, Policy S17 of the Dudley Borough Development Strategy, the Council’s Parking Standards SPD, and the relevant policies contained within the emerging Dudley Local Plan. The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design, residential amenities and trees that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
