The proposed two storey and single storey side and rear extensions, by reason of their cumulative excessive scale, massing, siting and design, would result in a dominant and incongruous form of development that would fail to appear subordinate to the host dwelling. The proposal would project beyond the established building line and introduce an extensive and uncharacteristic flat-roofed form on a prominent corner plot, causing significant harm to the character and appearance of the dwelling, the adjoining terrace and the wider street scene. The proposal is therefore contrary to Policies DLP4, DLP14 and DLP39 of the Dudley Local Plan (2026), the Residential Design Guide SPD (2023), and the National Planning Policy Framework (2026).
The proposed two storey side/rear extension, by reason of its scale, positioning and relationship with the neighbouring dwelling at No. 32 The Quadrant, would introduce a first-floor habitable room window and built form in close proximity to the shared boundary, resulting in an unduly overbearing form of development and an unacceptable impact upon the neighbouring occupiers' privacy and residential amenity through perceived overlooking. The proposal would therefore be contrary to Policies DLP14 and DLP39 of the Dudley Local Plan (2026) and the guidance contained within the Residential Design Guide SPD (2023).
Insufficient information has been submitted to enable the Local Planning Authority to properly assess the impact of the proposed development on existing protected tree within the site. Consequently, it has not been demonstrated that the development would safeguard the health, longevity and retention of protected trees, or avoid harm to their root protection areas during construction. In the absence of adequate arboricultural information, the Local Planning Authority cannot be satisfied that the proposal would not result in unacceptable harm to protected tree on site. The proposal is therefore contrary to Policies N2 and N3 of the National Planning Policy Framework (2026) and Policy DLP33 of the Dudley Local Plan (2026). Refusal Statement Informative The Local Planning Authority is aware of the requirement of Policy DM 3 of the National Planning Policy Framework 2026 to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design, impact upon neighbouring residential amenity, and the absence of sufficient arboricultural information to adequately assess the effects upon protected trees that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
