  1. The retrospective loss of this amenity land to an independent commercial use has resulted in the erosion of essential amenity provision serving the adjacent residential properties, for which no alternative provision exists. The commercial use as carried out undermines the residential function and living conditions of the adjoining dwellings. Given the established and safeguarded use of the site for amenity purposes, the introduction of an alternative commercial use is unacceptable in principle and contrary to the purpose for which the land was retained. As such, the development as implemented is contrary to the National Planning Policy Framework, Policy L1 of the Dudley Borough Development Strategy, the Residential Design Guide SPD, and the relevant policies of the emerging Dudley Local Plan.
  2. The development by reason of its poor appearance and siting forms an uncharacteristic and incongruous addition that fails to respect the design, character and appearance of the established setting, the development is at odds with and is not be reflective of the surrounding settlement pattern and landscape design, fails to secure a high quality and inclusive design, and fails to improve the distinctiveness, character and quality of the area and the way it functions. The loss of established boundary landscaping and trees has resulted in a significant and detrimental impact on local visual amenity. No replacement landscaping or tree planting is proposed to mitigate this loss as submitted. As such the development conflicts with the NPPF, the National Design Guide, Policies ENV2, ENV3 and CSP4 of the Black Country Core Strategy; Policies S1, S6, S7, S8 and S22 of the Dudley Borough Development Strategy, and the relevant policies contained within the emerging Dudley Local Plan.
  3. Insufficient information has been submitted to demonstrate that the development provides a safe and suitable means of vehicular access to the public highway. In particular, no details have been provided in respect of visibility splays, access layout, parking provision, or on site turning and manoeuvring arrangements to demonstrate that vehicles are able to enter and leave the site safely and in a forward gear. In the absence of this information, the Local Planning Authority cannot be satisfied that the access as constructed and used does not result in harm to highway safety or adversely affect the safe movement of vehicles, cyclists, and pedestrians using the adjoining highway. The development as carried out therefore fails to comply with the National Planning Policy Framework (2024), Policy TRAN2 of the Black Country Core Strategy (2011), Policy S17 of the Dudley Borough Development Strategy (2017), the Dudley Parking Standards Supplementary Planning Document (2017), and the relevant policies of the emerging Dudley Local Plan.
  4. Insufficient information has been provided to establish the baseline pre-development biodiversity value of the site and how the applicant intends to achieve the mandatory 10% biodiversity net gain requirements as set out within Schedule 7A of the Town and Country Planning Act 1990 (inserted by the Environment Act 2021). Refusal Statement Informative The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design, residential and visual amenities and highway safety that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
