  1. Insufficient information has been provided with this submission to demonstrate on the balance of probabilities that the proposed mobile home would meet with the definition of a caravan as set out within Section 29(1) Caravan Sites and Control of Development Act 1960; and that the siting of the mobile home would not constitute a ‘building’ or result in ‘operational development’ as set out in Section 55 and Section 336 (1) of the Town and Country Planning Act 1990.
  2. The siting of a mobile unit for residential purposes within the curtilage of an Opticians would result in a material change of use of the land as set out in Section 55 of the Town and Country Planning Act 1990 for which planning permission would be required. Furthermore, the Opticians does not benefit from permitted development rights under the Town and Country Planning (General Permitted Development) (England) Order 2015 for the siting of a residential mobile unit within the rear garden, and therefore planning permission would be required for the works proposed.
