The application fails to demonstrate that the change of use to an educational facility can operate safely or satisfactorily in highway terms. The layout provides insufficient and undersized parking spaces, inadequate manoeuvring areas, and no tracking or technical evidence has been provided to demonstrate that vehicles associated with the use, including minibuses, can enter, turn within, and exit the site safely in a forward gear. The absence of adequate information and the shortfall in parking provision collectively results in an unacceptable impact on highway safety. As such, the development conflicts with the guidance contained within the National Planning Policy Framework (2024), policies TRAN2 and HOU5 contained within the Black Country Core Strategy (2011), policy S17 of the Dudley Borough Development Strategy (2017), the Parking Standards SPD (2017) and policies DLP16 and DLP69 of and the emerging Dudley Local Plan. Refusal Statement Informative The Local Planning Authority is aware of the requirement of paragraph 39 of the National Planning Policy Framework to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to highways safety that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
