The proposed development, by reason of its footprint, siting and extent of site coverage, would represent an overintensive and visually intrusive form of backland development within the rear garden of the host property. The proposal would appear contrived and out of character with the established pattern, spatial form and grain of development, resulting in harm to the character and appearance of the Area of High Historic Townscape Value. The proposal is therefore contrary to the National Planning Policy Framework (2024), Policies ENV2 and ENV3 of the Black Country Core Strategy (2011), Policies L1, S6 and S12 of the Development Strategy (2017), the Residential Design Guide SPD (2023) and the emerging Dudley Local Plan.
The proposed House in Multiple Occupation, by reason of its cramped internal layout, insufficient communal living space, lack of meaningful private outdoor amenity and compromised privacy, would fail to provide a good standard of residential amenity for future occupiers. The proposal is therefore contrary to the National Planning Policy Framework (2024), the National Design Guide (2019), Policy ENV3 of the Black Country Core Strategy (2011), Policy L1 of the Development Strategy (2017), the Residential Design Guide SPD (2023) and the emerging Dudley Local Plan.
The proposed three bedroom House in Multiple Occupation, in the absence of any onsite parking provision, would result in increased on street parking demand within the surrounding highway network to the detriment of highway safety. The proposal is therefore contrary to the National Planning Policy Framework (2024), Policy TRAN2 of the Black Country Core Strategy (2011), the Parking Standards Supplementary Planning Document (2017), the Residential Design Guide SPD (2023) and the emerging Dudley Local Plan. The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design, highway safety and residential amenity that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
