  1. The proposed industrial development would occupy a site allocated for residential use within the emerging Dudley Local Plan which is at an advanced stage and therefore carries substantial weight in accordance with paragraph 49 of the NPPF. The proposal has failed to demonstrate that it would not prejudice the comprehensive delivery of the emerging housing allocation and as a result it is considered that the introduction of an industrial unit would therefore undermine the future delivery of housing and the Council's ability to meet identified housing needs. The proposal is therefore contrary to paragraphs 11(d), 49, 79(c), 125(c) and 125(d) of the NPPF and Policies DLP1 and DLP10 of the emerging Dudley Local Plan.
  2. Insufficient information has been provided to demonstrate that the development would provide safe and suitable access, adequate parking provision, or appropriate servicing and manoeuvring arrangements. No parking layout, servicing strategy, or details of expected vehicle movements or staffing levels have been provided. In the absence of this information, the Local Planning Authority cannot be satisfied that the proposal would operate safely or without adverse impact on the local highway network. The proposal therefore fails to comply with Policy TRAN2 of the Black Country Core Strategy, paragraph 116 of the NPPF and the Parking Standards SPD.
  3. The proposed development lies immediately adjacent to the Dudley No.2 Canal and a retaining wall supporting Canal Side and the canal towpath. Insufficient information has been provided to demonstrate that the proposed development and associated construction works can proceed without posing a risk to land stability or the integrity of the canal infrastructure. The proposal is therefore contrary to paragraphs 196-197 of the NPPF and Policy ENV4 of the Black Country Core Strategy. The Local Planning Authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the Local Planning Authority maintains that the principle of development cannot be supported as the scheme is contrary to the emerging Development Plan and the proposal would not result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
