Decision & conditions

Decision Notice
Planning conditions
  1. The LPA is unable to object to the proposed works as the ash tree does not meet the amenity threshold required to justify a Tree Preservation Order. However, the LPA does not endorse the works, which are contrary to arboricultural best practice and likely to cause significant long term decline of the tree. For clarity, the LPA has no authority to permit or regulate access to third party land. A notice of ‘no objection’ relates solely to planning legislation and does not grant permission to enter neighbouring property. Responsibility for obtaining the landowner’s consent rests entirely with the applicant. Applicants are also advised that undertaking unauthorised works or entering land without the owner’s consent may expose them to civil action and/or enforcement action where relevant legislation is breached.
