Decision Notice Appeal decision
Planning conditions
  1. The proposed development, by reason of the siting and arrangement of two offstreet parking spaces within the prominent side garden area, together with the associated closeboarded boundary fencing, would result in a contrived, visually intrusive and uncharacteristic form of development and would cause unacceptable harm to local character, contrary to Policy S6 of the Development Strategy, Policy ENV3 of the Black Country Core Strategy, the Residential Design SPD, and the National Planning Policy Framework (2024).
  2. The proposal would provide a very limited amount of usable private amenity space due to the combined footprint of two parking spaces, bin storage and cycle storage occupying the majority of the rear garden. This would fail to provide an appropriate and meaningful outdoor environment for a child in residential care and would not achieve an acceptable standard of living conditions for future occupiers. The development is therefore contrary to Policy L2 of the Dudley Borough Development Strategy, the Residential Design SPD, the emerging Dudley Local Plan, and the National Planning Policy Framework (2024). The local planning authority is aware of the requirement of paragraph 39 in the National Planning Policy Framework to work with the applicant in a positive and proactive manner, seeking solutions to problems arising in relation to dealing with the application. In this case, despite receipt of amended plans there are insurmountable technical issues relating to amenity and design that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
  3. The development hereby permitted shall begin not later than three years from the date of this decision.
  4. The development hereby permitted shall be carried out in accordance with drawing No. 5120-210 (Plans-Elevations).
  5. Notwithstanding the provisions of the Town and Country Planning (Use Classes) Order 1987 (or any order revoking and re-enacting that order) the premises shall be used only as a children's care home for up to one child and for no other use falling with Class C2 of the Order.
