The proposal would constitute an inappropriate form of backland development introducing one detached dwelling in marked contrast with the existing pattern of development. Furthermore, by reason of the lack of street frontage and in combination with the existing large garage/gym structure to the rear of 9 Wood Street, the proposal would be considered to form a cramped and contrived development that would be out of character, appear incongruous locally and would fail to respect the existing grain of development. This results in poor design that would be harmful to the character and appearance of the area and would be considered contrary to guidance within the NPPF, Policies DLP4, DLP14 and DLP39 Dudley Local Plan and the Residential Design Guide SPD.
The proposal would fail to provide sufficient private amenity as prescribed within the Residential Design Guide (2023) and would be considered to cause demonstrable harm to occupier amenity, contrary to guidance within the NPPF, Policies DLP4, DLP14 and DLP39 Dudley Local Plan and the Residential Design Guide SPD.
Insufficient information has been submitted to demonstrate that the proposed development can provide safe and suitable access/egress arrangements, manoeuvring on site and parking. The proposal has therefore failed to demonstrate that adequate parking, vehicle manoeuvring facilities and safe access for all highway users can be achieved without detriment to highway safety, contrary to Policies TR3 and TR4 of the National Planning Policy Framework (2026), Policies DLP14, DLP65 and Appendix 7: Parking Standards of the Dudley Local Plan. Refusal Statement Informative The Local Planning Authority is aware of the requirement of Policy DM 3 of the National Planning Policy Framework 2026 to work with the applicant in a positive, proactive and creative manner, seeking solutions to problems arising in relation to dealing with the application. In this case, after careful balanced consideration the LPA/Officers considers that there are insurmountable technical issues relating to design, occupier amenity and highways and the wider area that have not been satisfactorily resolved to demonstrate that the scheme would result in the creation of a sustainable form of development and thereby failing to improve the economic, social and environmental conditions of the area.
