  1. The proposed use of the premises to provide care and support for 2 young persons would generally be held to fall within Class C2 of the Order (Residential institutions). However, the evidence suggests that the activity associated with the proposed use would not be materially different from that which preceded it (as a conventional dwellinghouse). As such, the change of use is not material, so planning permission is not required. It is therefore appropriate to issue a lawful use certificate.
  2. First Schedule The use of a dwellinghouse as a children’s care home pursuant to the Children’s Act 2000 for children who fall within the Ofsted registration for children with learning disabilities, in which: 1) No more than two children are receiving care at any one time; 2) The children in care are aged from 7 to 17 years’ old; 3) The children in care would occupy the premises on a medium to long term basis. 4) No family visits to children normally take place; 5) There are no more than (a) two staff on duty per shift pattern, (b) one visiting manager to the home per day. 6) No business /staff meetings or staff training of any kind take place; 7) No regular homeschooling will take place on site.
