The application site is constrained by the Root Protection Areas of five mature trees protected by Tree Preservation Order No. 1995/01. Due to the extent of the Root Protection Areas and the proximity of these trees to the site, the Local Planning Authority is not satisfied that the site is capable of accommodating a dwelling, access and associated development whilst safeguarding the long-term retention of the protected trees. Furthermore, the proximity and scale of the trees would result in significant shading and reduced residential amenity for future occupiers and are likely to create future pressure for pruning or removal. As such, the Local Planning Authority is not satisfied that the site is suitable for residential development in principle. The proposal is therefore contrary to Sections 197 and 198 of the Town and Country Planning Act 1990.
The application site is situated within the 15Km Zone of Influence for the Cannock Chase Special Area of Conservation (SAC). As such, the application fails to comply with Part 2A, Section 5B of The Town and Country Planning (Permission in Principle) (Amendment) Order 2017. The development would result in harm to the integrity of the Cannock Chase Special Area of Conservation through additional recreational pressure arising from the scheme through the construction of new dwellings. In the absence of bespoke mitigation or a signed Unilateral agreement to secure necessary financial mitigation towards the Cannock Chase Special Area of Conservation Delivery Implementation Plans (DIPs) the harm is unacceptable and the development fails to conform with Policy SO7.3 of the Cannock Chase Local Plan (2026), the Conservation of Habitats and Species Regulations 2017 and the National Planning Policy Framework.
