  1. The Local Planning Authority is not satisfied, on the balance of probability, that the operations and use described in the application would be lawful. Whilst the proposed rear extension would constitute permitted development under Class A, Part 1, Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), the submitted plans show the creation of a 7-bedroom House in Multiple Occupation. The proposal would therefore result in a material change of use from a Class C4 HMO to a Sui Generis HMO, for which planning permission would be required. The proposal therefore falls outside the scope of development that can be certified as lawful through a Lawful Development Certificate. Accordingly, the application is refused.
