Planning conditions
  1. In accordance with Paragraph 38 of the National Planning Policy Framework, the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development. However, in this instance the proposal fails to accord with the Local Plan and the National Planning Policy Framework.
  2. 1. The proposed development, by reason of its cumulative size, scale, bulk and massing, would result in a disproportionate addition over and above the size of the original building. The proposal would materially increase the amount of built form on the site and would adversely affect the openness of the Green Belt. The development therefore constitutes inappropriate development within the Green Belt. No very special circumstances have been demonstrated which clearly outweigh this harm and the substantial weight that must be given to Green Belt harm. The proposal is therefore contrary to Paragraphs 142 and 154(c) of the National Planning Policy Framework and Policy SO7.6 of the Cannock Chase Local Plan.
  3. 2. The proposed building, by virtue of its size, design, layout, physical separation from the host dwelling and provision of all facilities necessary for independent day-to-day living, would not function as accommodation ancillary to the host dwelling and would instead amount to a separate self-contained unit of residential accommodation. The proposal would therefore constitute the creation of a new dwellinghouse within the Green Belt which represents inappropriate development for which no very special circumstances have been demonstrated and is contrary to Paragraphs 142 and 154 of the National Planning Policy Framework and Policy SO7.6 of the Cannock Chase Local Plan.
