Planning conditions
  1. The proposed rear boundary wall, by reason of its height, length, scale and siting directly adjacent to the rear boundary, would appear as an unduly prominent, visually dominant and incongruous form of boundary treatment, causing harm to the character and appearance of the immediate area. In addition, due to the significant difference in land levels between the application site and the adjoining properties on Chaseside Drive, the wall would have an unacceptable overbearing impact upon the rear gardens and rear-facing outlook from Nos. 5, 7 and 9 Chaseside Drive, to the detriment of the living conditions of neighbouring occupiers. The proposed planting and infill fence panels would not adequately mitigate the identified harm. The development would therefore be contrary to Policies SO1.2 and SO2.2 of the Cannock Chase District Local Plan 2018–2040, the Council’s Design Supplementary Planning Document, and the National Planning Policy Framework.
  2. Reason for Refusal of Planning Permission In accordance with paragraph (38) of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development. However, in this instance the proposal fails to accord with the Local Plan and the National Planning Policy Framework.
