Planning conditions
  1. The proposed amendment would result in the garages approved under planning permission CH/23/0279 no longer being available for the parking of motor vehicles and cycles, instead facilitating additional living accommodation. This would be contrary to Condition 13 of planning permission CH/23/0279. As the proposal would conflict with and require the variation or removal of an existing condition, the amendment is considered to be material and does not fall within the scope of section 96A (non material amendments). The proposed amendment cannot therefore be dealt with as a non material amendment. Any such change would require the removal or variation of Condition 13 through the submission of either a Section 73 application or a full planning application.
