Planning conditions
  1. Whilst the proposed single storey rear extension is compliant with Class A within Part 1 of Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015, the proposals as shown in the submitted plans do not align with Class A Part 1. The addition of 2no bedrooms will cause the property, in practice, to function as a larger HMO within a Sui Generis use class and therefore a material change of use will take place. This cannot be assessed under a Lawful Development Certificate and so the application is refused.
  2. Reason for Refusal of Planning Permission In accordance with paragraph (38) of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development. However, in this instance the proposal fails to accord with the Local Plan and the National Planning Policy Framework.
