  1. In accordance with paragraph 38 of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development, which accords with the Local Plan and the National Planning Policy Framework.
  2. The hereby approved takeaway use shall not be open for business outside the hours of 08:00hrs to 20:00hrs Monday to Friday, 08:00hrs to 18:00hrs on Saturdays and 08:00hrs and 16:00hrs on Sundays and Public / Bank Holidays. Reason To ensure that the proposed development does not prejudice the enjoyment by neighbouring occupiers of their properties and to ensure compliance with Local Plan Policies SO1.2, SO2.2 & SO4.2 and the NPPF.
  3. The development hereby permitted shall be retained in accordance with the following approved plans: • Proposed Kitchen area - PLANNING DETAILS - 485/PD/01 - B Reason For the avoidance of doubt and in the interests of proper planning.
  4. The takeaway use hereby permitted shall operate only as an ancillary use to, and in conjunction with, the established meat and poultry business at 173 Peter Rosa Retail Centre, Walsall Road, Cannock, WS11 0JH. The takeaway use shall not operate independently as a separate takeaway unit without the prior written permission of the Local Planning Authority. Reason To ensure that the use remains ancillary to the primary retail function of the premises and to safeguard the character of the area, in accordance with relevant planning policies.
