The proposed use of the premises to provide care and support for 3 young persons would generally be held to fall within Class C2 of the Order (Residential institutions). However, the evidence suggests that the activity associated with the proposed use would not be materially different from that which preceded it (as a conventional dwellinghouse). As such, the change of use is not material, so planning permission is not required. It is therefore appropriate to issue a lawful use certificate. First Schedule The use of a dwellinghouse as a children’s care home pursuant to the Children’s Act 2000 for children who fall within the Ofsted registration for children with emotional/behavioural difficulties, in which: 1) No more than three children are receiving care at any one time; 2) The children in care are aged from 6 to 18 years’ old; 3) No parental visits to children normally take place; 4) There are no more than (a) three care staff on duty during the daytime, (b) two care staff on duty staying overnight, working 48hr shift patterns, (c) visiting manager and deputy manager on occasion, at the premises per day. 5) No business meetings or staff training of any kind take place; 6) No regular homeschooling will take place on site.
