  1. Reason for Refusal of Planning Permission In accordance with paragraph (38) of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development. However, in this instance the proposal fails to accord with the Local Plan and the National Planning Policy Framework.
  2. The removal of original chimney stacks and addition of a large box dormer would harm the character and appearance of the Talbot Street/Lichfield Street Conservation Area by introducing an incongruous modern feature and eroding traditional architectural elements. This results in less than substantial harm to a designated heritage asset, with limited public benefit that does not outweigh the harm. The proposal is therefore contrary to Policy CP15 of the Local Plan, the Council’s Design Guidance, Paragraphs 208 and 215 of the NPPF, and the statutory duty under Section 72(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990.
  3. The application fails to provide sufficient ecological information to assess the potential impact of the proposed demolition on roosting bats, a European Protected Species. In the absence of a Preliminary Roost Assessment, the Local Planning Authority cannot conclude that the proposal would not result in harm to bats. As such, the proposal is contrary to Policies CP12 and CP13 of the Cannock Chase Local Plan and paragraph 193 of the National Planning Policy Framework.
