  1. Overall, the evidence provided by the applicant supports the case, therefore on the balance of probability, the proposed use of the land is lawful and a certificate of lawful development can be approved.
  2. First Schedule The use of a dwellinghouse as a children’s care home pursuant to the Children’s Act 2000 for children who fall within the Ofsted registration for children with learning disabilities, in which: 1) No more than two children are receiving care at any one time; 2) The children in care are aged from 12 to 18 years’ old; 3) No parental visits to children normally take place; 4) There are no more than (a) two staff on duty per shift pattern (b) one visiting manager to the home per day. 5) No business meetings or staff training of any kind take place; 6) No more than three vehicles are parking at or around the home at any one time
