Planning conditions
  1. This approval of Reserved Matters is granted in respect of Outline permission CH/19/201 (as subsequently varied) and the development hereby approved shall comply in all respects with the terms of that permission and the conditions imposed on it (insofar as they are relevant to this development). Reason: To ensure compliance with the approved outline permission in respect of this particular phase of development and to deliver a high quality form of development, in accordance with the requirements of SM1 of the Cannock Chase Local Plan.
  2. The development authorised by this permission shall be carried out in complete accordance with the approved plans and specification, as listed within Drawing Register dated 23/04/26, except insofar as may be otherwise required by other conditions to which this permission is subject. Reason: For the avoidance of doubt and to ensure a satisfactory form of development.
  3. The development shall be carried out in full accordance with the following approved documents: – Habitat Management and Ecological Mitigation Strategy 5084 HMEMS 0&1 CB/CK/MM v2 dated 25/03/2026; – Ecological Enhancements Plan 7084/EEP1 Rev F/JP dated March 2026 (as contained within the approved HMEMS), unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of assuring the long term management and habitat creation set out within the submitted documents in accordance with Policy SO7.1 and SO7.2.
  4. Monitoring in accordance with the methodology specified in Section 10 (Monitoring and Review) of the approved Habitat Management and Ecological Mitigation Plan shall be undertaken and monitoring reports submitted to the Local Planning Authority within three months of completion of each monitoring exercise. Where monitoring identifies that the management objectives or biodiversity outcomes are not being met, remedial measures and/or amended management prescriptions shall be submitted to and approved in writing by the Local Planning Authority and implemented as approved. Monitoring and review shall continue for the lifetime of the approved plan, unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of assuring the long term management and habitat creation set out within the submitted documents in accordance with Policy SO7.1 and SO7.2.
  5. No part of the development above ground level shall be undertaken until, an open space strategy is submitted to and approved by the LPA. The Open Space Strategy shall show the phasing of implementation of the open space, landscaping and play areas relative to the delivery of housing in that phase. The open space, play areas and landscaping shall be carried out in accordance with the timetable detailed on the approved phasing plan unless otherwise agreed in writing by the Local Planning Authority. Thereafter the landscaping works shall be carried out in accordance with the approved details. All planting within the approved scheme shall be carried out in line with the phasing plan and planted in the first planting season following the completion of the relevant phase. Any trees, hedge or shrub which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species. Reason: In the interest of visual amenity of the area. In accordance with Local Plan Policies SO1.2, SO2.2, SO7.4 & SO7.5 and the NPPF.
  6. The site landscaping, open space and play facilities, following completion of establishment, shall be managed in accordance with the approved Landscape Management Plan Ref 8841.LMP.002, unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of visual amenity of the area. In accordance with Local Plan Policies SO1.2, SO2.2, SO7.4 & SO7.5 and the NPPF.
  7. 7. Prior to first occupation of the dwellings hereby permitted, the SUDS and drainage measures as detailed in the Flood Risk Assessment/Drainage Strategy documents shall be constructed and fully operational in accordance with the following approved documents: Drainage Strategy, Project Number 22183 – Revision B - 16th March 2026 Adoptable Drainage Sheet 1-4, Project No: 22183, Drawing No:100, Rev B. Date 13.04.26 Private Drainage and External Works Sheet 1-7, Project No: 22183, Drawing No:110, Rev A. Date 27.03.26 Reason: To prevent flooding by ensuring the satisfactory storage and disposal of surface water from the site and to ensure lifetime maintenance of the system to prevent flooding issues in accordance with Local Plan Policy SM1.
  8. The affordable housing to be delivered as part of the development shall be provided in accordance with the submitted Affordable Housing Statement dated 19 December 2025 unless otherwise agreed in writing with the Local Planning Authority. Reason: In order to assure the affordable dwellings on the site are provided for in line with the Local Plan Policies SM1 and SO3.2 as far as possible.
  9. All dwellings within the development shall be constructed to Category M4(2) (Accessible and Adaptable dwellings) of Approved Document M: access to and use of buildings, with the exception of the flatted housing proposed. Reason: In the interests of assuring compliance with Local Plan Policy SO3.3 (c) to provide for accessible and adaptable dwellings.
  10. Development above ground level shall not be undertaken until a scheme demonstrating at least 5% of housing is to be provided as wheelchair user dwellings equivalent to M4(3) of the Building Regulations, has been submitted to and agreed in writing by the Local Planning Authority. This requirement shall increase to 10% of affordable housing delivered for wheelchair users. Thereafter the development shall be carried out in accordance with the agreed scheme unless otherwise agreed in writing. Reason: In the interests of assuring compliance with Local Plan Policy SO3.3 (c) to provide for accessible and adaptable dwellings.
  11. Prior to development above ground level, a detailed lighting scheme for the development shall be submitted to and approved by the Local Planning Authority. This shall include housing estate areas and all adjacent public footpaths and open space, and shall detail maintenance responsibility and energy consumption responsibility for installed lighting. The approved scheme shall be implemented in a phased manner to support relevant occupations and shall be adhered to for the lifetime of development unless otherwise agreed in writing. Reason: In the interests of safety and security and in accordance with Local Plan Policy SO1.3.
  12. Prior to development above ground level, details of a scheme to assure security and prevent unauthorised access beyond the Bridge Parapet over the A51 shall be submitted to and agreed in writing by the Local Planning Authority. Prior to 50% occupation of this phase, the agreed scheme shall constructed/implemented in accordance with the approved details. Reason: In the interests of safety and security and in accordance with Local Plan Policy SO1.3.
  13. Prior to development above ground level, details of a scheme of security measures to the apartment blocks shall be submitted to and agreed in writing by the Local Planning Authority. Prior to occupation of apartments, the agreed scheme shall constructed/implemented in accordance with the approved details. Reason: In the interests of safety and security and in accordance with Local Plan Policy SO1.3.
  14. The mitigation measures set out in the submitted Air Quality Assessment Section 7 of the Report 333701660-STN-XX-XX-RP-AQ-0001-P01 shall be implemented during both the construction and operational phases of development, unless otherwise agreed in writing by the LPA. Reason: In the interests of protecting the amenity of existing and prospective users of land and buildings in the vicinity in accordance with Local Plan Policy SO2.2.
  15. The mitigation measures set out in the submitted Noise and Vibration Impact Assessment Section 5 Ref 333701660-STN-XX-XX-RP-AC-0001 P01_S2 shall be implemented in full, unless otherwise agreed in writing with the LPA. Reason: In the interests of protecting the amenity of existing and prospective users of land and buildings in the vicinity in accordance with Local Plan Policy SO2.2.
  16. Prior to occupation of any dwellings, a fire strategy including fire vehicle tracking, location of fire hydrants and/or sprinklers shall be submitted to and agreed in writing with the LPA. The approved scheme shall thereafter be implemented and maintained as such. Reason: In the interests of protecting the amenity of existing and prospective users of land and buildings in the vicinity in accordance with Local Plan Policy SO2.2.
  17. Prior to development above ground level, a scheme detailing path levels along the relevant length of the “Rail Way” pedestrian cycle route shall be submitted to and agreed in writing by the Local Planning Authority. The levels shall as far as possible be designed and built to promote accessibility for all. In particular the submissions shall include details of levels, surfacing and required retaining at the connection to the public highway at Power Station Road (having regard to the railway embankment constraints) and the connection/transition down from the route at the NEAP / link to the local centre. The scheme shall also include details of any future maintenance responsibility. Thereafter the approved scheme shall be implemented in accordance with the timeline required by Outline Planning Condition 48. Reason: In the interests of sustainability, accessibility and healthy living in accordance with Local Plan Policy SO2.5.
  18. The temporary coach stop facilities serving the school shall be removed before work commences to construct plots 319-372 at the eastern extent of the RM site area. Reason: In the interests of minimising vehicular conflict and assuring the safety of school pupils in accordance with Local Plan Policy SO5.1.
  19. At such time as 21/0308 and the links to the Riverside Park are known and under construction, details of a proposed connection into the Riverside Park from the Rail Way within Phase 1 shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the agreed method of connection into the Riverside Park shall be delivered within 6 months of approval of the details, unless otherwise agreed in writing by the Local Planning Authority. Reason: In the interests of sustainability, accessibility and healthy living in accordance with Local Plan Policy SO2.5.
  20. Highway Approvals Development of the road and drainage layout will require approval under Section 7 of the Staffordshire Act 1983 and will require an agreement under Section 38 of the Highways Act 1980 if it is to be adopted as ‘highway maintainable at public expense’. There are detailed issues that need to be approved in order to achieve technical approval under that process and the developer should be advised to contact Staffordshire County Council to ensure that approvals and agreements are secured before commencement of works. The obtaining of planning permission for this design/layout will not be considered as a reason to relax the required technical standards for the adoption of the road and drainage and any changes may necessitate the submission of further planning applications. If the road is to be private then the residents should be advised that they may be taking on the responsibilities and liabilities of the highway authority with regards to maintenance, snow clearance etc and are advised to take advice on public liability insurance against claims associated with those responsibilities.
  21. Railway Proximity The applicant is advised to note and act upon as necessary the comments and requirements of Network Rail dated 13th June 2019 within the original outline application CH/19/201. These highlight to need for appropriate risk assessment and controls to be put in place to secure the safety and efficient operation of national rail infrastructure.
  22. National Grid National Grid Electricity Distribution (NGED) has Extra High Voltage (EHV) (132kV and 400kV) network installed in proximity. NGED welcomes contact with the developer and MUST be contacted in all instances for safety guidance, proximity clearances and clear working methodologies related to locating equipment and safe working practices prior to any physical (or survey) works in the vicinity of cables. Any alteration, building or ground works proposed with the proximity of any network, apparatus or equipment that may or may not directly affect cables or conductors, MUST be notified in detail to National Grid Electricity Distribution.
  23. Reason for Grant of Permission In accordance with paragraph 38 of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development, which accords with the Local Plan and the National Planning Policy Framework.
