The site is located within a town centre environment, surrounded by a mix of uses including late-night activities such as public houses. Furthermore, insufficient information has been provided regarding the nature of the proposed Class E use on the ground floor and its potential impact on the proposed residential unit’s amenity. In the absence of an appropriate noise risk assessment, the Local Planning Authority cannot adequately assess the potential for noise disturbance arising from both the surrounding town centre uses and the proposed ground floor use. Consequently, the proposal fails to demonstrate compliance with paragraphs 135 and 198 of the National Planning Policy Framework, which seek to ensure a high standard of amenity for future occupiers.
The proposed development fails to provide an acceptable standard of amenity for future occupiers. The HMO bedrooms are small with limited circulation space, and the single kitchen/dining area does not offer a suitable communal space for social interaction and relaxation. No outdoor amenity space is provided, further reducing opportunities for relaxation outside of bedrooms. Therefore, the proposal does not demonstrate compliance with Cannock Chase Local Plan (2014) Policy CP3 and paragraph 135(f) National Planning Policy Framework, which require high-quality living conditions and a healthy environment.
The application fails to provide sufficient information to demonstrate that the proposed intensity of use, accommodating up to 10 occupants, alongside visitors, would not result in an adverse impact on neighbouring uses. The absence of a HMO Management Plan means the Local Planning Authority cannot assess how tenant behaviour would be managed to avoid potential conflict with surrounding uses. In the absence of this information, the proposal fails to demonstrate compliance with paragraph 198 of the National Planning Policy Framework, which seeks to ensure development is compatible with surrounding uses and does not result in unacceptable impacts on amenity.
The submitted plans fail to demonstrate that the proposed parking area to the rear of the site can be safely accessed or that adequate manoeuvrability for vehicles can be achieved. Furthermore, the proposed cycle parking provision falls below the Cannock Chase Parking Standards, Travel Plans and Developer Contributions for Sustainable Transport. This shortfall fails to support sustainable travel objectives in this location. In the absence of this information, the Local Planning Authority cannot conclude that the proposal would accord with the paragraph 116 of the National Planning Policy Framework, which seek to ensure safe and suitable vehicle access for all users and promote sustainable transport.
The site lies within Flood Zone 3 as identified on the Environment Agency’s Flood Zone Maps and is also at risk of surface water flooding. The submitted Flood Risk Assessment fails to provide sufficient detail to demonstrate that the development would be safe for its lifetime without increasing flood risk elsewhere. Specifically, the assessment does not confirm that the design flood level has accounted for the 1 in 100-year fluvial flood event plus climate change allowance (29%), nor does it include finished floor levels and external ground level topographic plans. In addition, resilience measures identified by the submitted Flood Risk Assessment have not been incorporated into the site design. In the absence of this information, the Local Planning Authority cannot conclude that the proposal would provide a satisfactory level of protection for future occupiers or comply with paragraph 170 of the National Planning Policy Framework.
The development would fail to provide an acceptable standard of outlook for future occupiers of the proposed ground floor flat. The side and rear windows at ground floor level would directly face a neighbouring service yard, parking areas, and bin storage, resulting in views that are stark and visually unappealing. This would create a poor living environment and an unacceptable standard of residential amenity. The proposal is therefore contrary to Policy CP3 of the Cannock Chase Local Plan (2014) and paragraph 135(f) of the National Planning Policy Framework, which seek to ensure a high standard of amenity for future occupiers.
