Planning conditions
  1. In accordance with Paragraph 38 of the National Planning Policy Framework the Local Planning Authority has worked with the applicant in a positive and proactive manner to approve the proposed development. However, in this instance the proposal fails to accord with the Local Plan and the National Planning Policy Framework.
  2. There is a significant difference in levels between the properties within Swallowfields Drive and those in Chaffinch Close. In this instance, the fence, by virtue of its height and elevated position, appears disproportionately tall and out of keeping with the scale and form of surrounding structures. Furthermore, the proposal has brought the elevated fencing closer and higher to the neighbours at No. 25 Chaffinch Close which has resulted in a boundary that significantly exceeds what is typical for a domestic fence, leading to an adverse visual impact to the neighbouring occupiers and a detrimental impact to the private amenity space for No.25 Chaffinch Close. As such, the proposal is contrary to Policy CP3 of the Cannock Chase Local Plan and Paragraph 135 of the NPPF.
  3. The fence, by virtue of its height and elevated position immediately adjacent a public pathway, results in an unacceptable overbearing impact to users of the pathway. The fence creates a sense of enclosure and appears as a dominant structure when viewed from pathway, causing harm to the amenity of users of the pathway. The proposal is therefore contrary to Policy CP3 of the Cannock Chase Local Plan and Paragraph 135 of the NPPF.
