The applicant seeks to exercise the powers granted under Section 96A of the Town and Country Planning Act 1990 to make a non-material amendment application to alter the wording of Condition 4 attached to the full planning approval (CCDC Application reference: CH/25/0064 determined on 1st July 2025). The purpose of the application is to allow for the repositioning of the approved pumping station equipment and compounds in order to allow for their adoption. The amendments do not result in an increase in height or area of the equipment or compounds. To secure these changes the applicant seeks to amend the wording to condition 4 as follows: The development hereby permitted shall be carried out in accordance with the following approved plans: 0059278-BHE-XX-XX-DR-C-31900 P02 Foul Water Drainage Pumping Station and Substation Site Location Plan 0059278-BHE-XX-XX-DR-C-01200 P00 Existing Topography & Utilities Overall Plan with Planning Boundary 0059278-BHE-XX-XX-DR-C-00100 P00 Existing and Proposed Contours Plan 0059278-BHE-XX-XX-DR-C-31901 P02 Foul Water Drainage Pumping Station and Substation Plan & Section 0059278-BHE-XX-XX-DR-C-37004 P01 Foul Drainage Pumping Station B Detail and Substation Plan Reason In the interests of proper planning and to define the consent. The Council assesses the proposed amendments do not give rise to any impacts which are material in the context of the scale and nature of the approved scheme. The changes remain in accordance with CCDC’s Development Plan and do not prejudice consultees or other interested parties when considered in the context of the original application. As such, this determination formally confirms the wording as shown in bold above is the new wording to condition 4 on approval notice CH/25/0064.
